On 27 June 2024 we delivered training on the new Environment Protection Legislation Amendment (Stronger Regulations and Penalties) Act 2024. Under this legislation, important changes have been made to the Protection of the Environment Operations Act 1997 which governs the way councils manage the illegal dumping of waste. There are new offences and higher penalties designed to deter people from disposing of household waste items in an unlawful manner.
Speakers included Marlie Caban and Mark Cottom, Co-Directors of Local Government Legal who provided an outline of the key changes and practical ways to implement these reforms on-the-ground. Topics included:
- New fines
- Smaller scale offences
- Evidence gathering
- Taking statements
- Preparing affadavits
This event targeted council officers involved in the prevention and management of illegal dumping in the Hunter Central Coast region. Through the Hunter Central Coast RID program, Local Government Legal are running a six-month pilot Legal Service Desk for all member councils, offering legal advice and assistance on illegal dumping matters.
