We are pleased to share our updated Hunter JO Register of Contaminated Land Consent Conditions!

The Hunter JO Register of Contaminated Land Consent Conditions (the Register) provides model ‘Requests for Information’ and ‘Conditions of Development Consent’ that can be used by Council staff when assessing and conditioning development applications involving contaminated land requirements.

It has been developed collaboratively with staff from Councils participating in the Hunter JO Contaminated Land Program and has undergone a technical review by the NSW Department of Planning and EPA, as well as a legal review by our Environment and Planning Law Specialists at  Local Government Legal  (a business unit of our partner organisation, Arrow Collaborative Services).

The Register is designed to:

• Provide a consistent approach by Councils in the Hunter region for the assessment and management of contaminated land through the development assessment process; and
• Ensure conditions of consent are appropriately worded to meet planning requirements and are enforceable in law

Conditions included in the Register were developed based on the principles of the Hunter JO (2023) guideline Developing Quality Conditions of Consent, available at the Hunter JO contaminated land webpage. The Register forms part of a series of guides and resources developed as supporting documents to the Model Contaminated Land Policy – Land Use Planning.

The NSW DPE Standard Conditions of Consent, being introduced from 30 June 2023, do not include any conditions specific to contamination. As such, Councils were provided with a draft version of our Register to consider when uploading their conditions of consent to the NSW Planning Portal.
